Retirement Mandate - State by State Requirement

As of June 2023, nine states have active state-mandated retirement programs, while 19 states have enacted a program.
Many state-sponsored retirement plans are Roth IRAs, which typically have lower contributions than 401(k) plans.
In most states, small businesses can choose between the state-provided program or other options like 401(k) plans based on their business needs and plan features.

Delaware	Auto-IRA program expected is set to be implemented by January 1, 2025
Hawaii	Hawaii approved its state-run IRA program in May 2022
Maine	Auto-IRA program expected to be implemented by spring 2024
Minnesota	Program details TBD
Missouri	MEP program is set to be implemented by September 1, 2024
Nevada	Program details TBD
New Jersey	Auto-IRA program was slated to launch in March 2022, although implementation timeline is TBD.
New Mexico	Auto-IRA program deadlines have been pushed back to July 1, 2024

Vermont	Auto-IRA program could be phased out for employers beginning July 2025.
